1. The agreement

These terms govern your use of Fluxnoma. By creating a workspace or using the service you agree to them. If you use Fluxnoma on behalf of a company, you represent that you can bind that company.

2. The service

Fluxnoma runs automated marketing and lead-generation agents for your workspace: sourcing prospects, detecting buying signals, enriching and verifying contact data, sequencing outreach, scoring leads, and generating content. Some features rely on third-party providers you choose to connect; their terms apply to their services.

3. Credits and billing

Usage is metered in credits (1 credit = 1 US dollar). Credits are deducted when agents perform billable work, itemized in your ledger. Purchased credits are non-refundable except where required by law; unused credits expire if a workspace is closed for more than 12 months. Subscription fees, where applicable, renew until cancelled.

4. Acceptable use

You agree to use outreach features only in compliance with applicable law, including anti-spam laws (such as CAN-SPAM and PECR), data-protection law (such as GDPR and CCPA), and the terms of any platform your campaigns touch. You will not use Fluxnoma to send deceptive or unlawful messages, harvest data about private individuals, harass anyone, or contact people who have opted out. We may suspend workspaces that endanger deliverability for others or breach this section.

5. Your data and responsibilities

You retain all rights to data you bring and data your agents produce for you. You are the data controller for prospect data in your workspace and are responsible for the lawful basis of your campaigns, the accuracy of claims in your messaging, and honoring unsubscribe requests. We process data on your behalf as described in the Privacy Policy.

6. AI-generated output

Agents draft messages, scores, and analyses with AI. Output may be inaccurate; review campaigns and claims before relying on them commercially. You are responsible for the messages your workspace sends.

7. Availability and changes

We aim for high availability but the service is provided "as is" without warranties. We may change or discontinue features with reasonable notice; if a paid feature is discontinued, unused prepaid credits for it will be refunded pro rata.

8. Liability

To the maximum extent permitted by law, our aggregate liability for any claims arising out of the service is limited to the amounts you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, lost profits, or losses caused by third-party providers.

9. Termination

You may close your workspace at any time. We may suspend or terminate for breach of these terms, with notice where practicable. On termination, sections that by nature survive (billing, liability, data responsibilities) continue to apply.
